END-USER LICENSE AGREEMENT (EULA)

IMPORTANT - READ CAREFULLY: This End-User License Agreement ("EULA") is a legal
agreement between you (either an individual or a single entity) and NENDI
("Licensor") for the software product identified above, which includes computer
software and may include associated media, printed materials, and "online" or
electronic documentation ("SOFTWARE PRODUCT").
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE PRODUCT, YOU AGREE TO BE
BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA,
DO NOT INSTALL OR USE THE SOFTWARE PRODUCT.
1. GRANT OF LICENSE
This EULA grants you the following rights:
- Installation and Use: You may install and use the SOFTWARE PRODUCT on your
devices for personal or professional use, within the features, device limits
and user limits of your selected free or paid plan.
2. RESTRICTIONS
You may NOT:
a) Resell access to the SOFTWARE PRODUCT without written authorization
b) Sell, rent, lease, license, distribute, or otherwise transfer the SOFTWARE
PRODUCT to any third party
c) Modify, adapt, translate, reverse engineer, decompile, disassemble, or
create derivative works based on the SOFTWARE PRODUCT
d) Remove any proprietary notices, labels, or marks from the SOFTWARE PRODUCT
e) Use the SOFTWARE PRODUCT in any manner that could damage, disable,
overburden, or impair the SOFTWARE PRODUCT
3. INTELLECTUAL PROPERTY
The SOFTWARE PRODUCT is protected by copyright laws and international copyright
treaties, as well as other intellectual property laws and treaties. The
SOFTWARE PRODUCT is licensed, not sold. All title and intellectual property
rights in and to the SOFTWARE PRODUCT remain with the Licensor.
4. COMMERCIAL USE
Professional and commercial use is permitted under your selected plan.
Paid features require an active subscription. Contact contact@launcher-app.com
for arrangements beyond the published plans.
5. NO WARRANTY
THE SOFTWARE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER
EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
6. LIMITATION OF LIABILITY
IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT,
OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR
LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION,
OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE
SOFTWARE PRODUCT.
7. TERMINATION
Without prejudice to any other rights, the Licensor may terminate this EULA if
you fail to comply with the terms and conditions of this EULA. In such event,
you must destroy all copies of the SOFTWARE PRODUCT.
8. UPDATES AND SUPPORT
The Licensor may provide updates, patches, and bug fixes at its sole discretion.
Support services, if any, are provided at the Licensor's sole discretion.
9. PRIVACY
By using the SOFTWARE PRODUCT, you acknowledge and agree to the Licensor's
Privacy Policy available at https://launcher-app.com/privacy
10. GOVERNING LAW
This EULA shall be governed by the laws of France. Any disputes arising from
this EULA shall be subject to the exclusive jurisdiction of the French courts.
11. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and the Licensor
concerning the SOFTWARE PRODUCT and supersedes all prior or contemporaneous
oral or written communications, proposals, and representations.
